01Introduction

These terms and conditions govern your purchase and use of practice tests and related digital products sold by Sharpmark Prep, operating at sharpmarkprep.com. By purchasing or using any Sharpmark Prep product, you agree to these terms in full.

02Copyright & intellectual property

All Sharpmark Prep practice tests, including their structure, scoring systems, solutions, and written content, are the original work of Sharpmark Prep and are protected by copyright. All rights not expressly granted to you under these terms are reserved.

03Originality & non-affiliation

Sharpmark Prep practice tests are created independently for self-study purposes. They are not affiliated with, endorsed by, sponsored by, or derived from the proprietary materials, question banks, or scoring methodology of any hedge fund, investment bank, private equity firm, or other employer or institution.

Any resemblance in timing or format to assessments used by firms in the finance industry reflects general, publicly known industry practice, not access to or reproduction of any firm's proprietary material.

04Fictional companies & data

All companies, company names, and financial figures used in Sharpmark Prep practice tests are entirely fictional and constructed for illustrative purposes only. Any resemblance to a real company, security, or publicly reported financial result is coincidental.

Nothing in a Sharpmark Prep product constitutes investment research, financial advice, or a real valuation of any existing security.

05Licence grant

Subject to payment of the applicable fee, where a fee applies, Sharpmark Prep grants you a personal, non-exclusive, non-transferable licence to use the purchased file for your own individual interview preparation. You may save a personal copy, print it for your own use, and complete it as many times as you like for your own practice.

06Restrictions

You may not resell, sublicense, rent, lease, or otherwise make any Sharpmark Prep file or its contents available to a third party, whether for payment or free of charge.

You may not copy, reproduce, republish, upload to a public or shared repository, distribute, or post any file, in whole or in part, on any website, forum, file-sharing service, or social platform.

You may not remove or alter any copyright or licence notice contained in a file, and you may not represent a Sharpmark Prep file as your own original work.

07No warranty

Sharpmark Prep products are practice and preparation tools built from general industry experience. They are provided for educational purposes only and do not guarantee any interview outcome, offer, or result.

Products are provided as is, without warranty of any kind, express or implied, to the maximum extent permitted by law.

08Limitation of liability

To the maximum extent permitted by law, Sharpmark Prep's total liability arising out of or in connection with any product is limited to the amount you paid for that product. Sharpmark Prep is not liable for any indirect, incidental, or consequential loss, including loss of income or interview opportunity, arising from use of a product.

Your statutory rights are not affected. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law, or other applicable law, that cannot lawfully be excluded.

09Refund policy

Sharpmark Prep products are digital files delivered automatically on purchase. Because of the instant, irreversible nature of digital delivery, all sales are final and no refund is offered once a file has been delivered, except as set out below or as required by law.

If a file you purchased was not delivered, or suffers a major failure, meaning it does not function as a practice test, is missing essential content, or is materially different from its description in a way that would have affected your decision to purchase, contact contact@sharpmarkprep.com and Sharpmark Prep will resolve the issue, including a refund where appropriate.

Minor issues, such as an isolated formula error, a formatting inconsistency, or a typographical error that does not prevent the file from functioning as a practice test, do not constitute a major failure. In these cases, Sharpmark Prep's remedy is to correct the error and provide an updated file within a reasonable time, rather than a refund.

Your statutory rights are not affected. This policy does not limit any refund, repair, or replacement you are entitled to under the Australian Consumer Law where a product suffers a major failure or otherwise fails to meet a consumer guarantee that cannot be excluded.

10Changes to these terms

These terms may be revised periodically. The version in effect at the time of your purchase applies to that purchase. Continued use of the website after an update constitutes acceptance of the revised terms.

11Governing law

These terms are governed by the laws of Australia. Any dispute arising from these terms or a Sharpmark Prep product is subject to the non-exclusive jurisdiction of the courts of Australia.
